As a citizen of Jamaica by: birth, marriage, decent or registration then your rights are protected under the Jamaica Constitution 1996. As such if your rights have been breached then the following remedies can be of great effect to you.

  1. Request a redress by sending a application to the Supreme Court in Jamaica.
  2. In cases where citizens are held without beyond 24 hours of being charged then according to the Bail Acts you have the right to apply for bail.
  3. If you are arrested you have the right to a lawyer and if you don’t have the police should provide on for you by contacting the duty counsel through the Legal Aid program (Ministry of Justice, n.d).

There are other remedies you can utilizes if your know that your rights under the Constitution Act of Jamaica 1962 is violated:

  • Informal Negotiations: this is where instead of going through a lengthy court, both parties sit and discussion possible solutions to the problem. It could be in the form of payment to on party as such the motive to sue has been dropped.
  • Filing a claim to with the Government: this means that a government agency will make the necessary steps to enforce your civil right on your behalf. The agency will determine how your case should be handled and where. No private lawsuit should be made especially in some civil cases. The claim to the government must be made first.
  • Filing a Private Lawsuit for Civil Right Violation: if you decide to make this decision you have to know where to file such claim. Based on the location you must state certain facts and allegations to show that the defendant is accountable for the violation of your civil right and whatever harm you’ve suffered (Find Law Team, 2019).
